Terms of Use

These Terms of Use ("Terms") govern your access to and use of the K5 Power Network website, power bank rental stations, and related services (collectively, the "Services"), operated by K5 Power Network, powered by The Yellow Network. By scanning a station QR code, renting a power bank, or otherwise using our Services, you agree to be bound by these Terms.

K5 Power Network provides self-service power bank rental stations placed at partner locations across Malaysia. Users may rent a power bank from any K5 station and return it to any K5 station in the network, subject to availability.

You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding agreement to use our Services. By using our Services, you represent that you meet these requirements.

• A rental begins once payment is confirmed and a power bank is dispensed from a K5 station.
• You are responsible for the power bank from the time it is dispensed until it is returned and confirmed as docked at any K5 station.
• Rental charges accrue based on rental duration, as displayed at the station or in-app at the time of rental, until the power bank is returned.
• Power banks must be returned in working condition. Loss, theft or damage may result in a replacement fee as set out at the point of rental.

Rental fees are charged through the payment method you select at the station, including Touch 'n Go eWallet, Visa, Mastercard, WeChat Pay, Alipay, PayNow. All fees are shown prior to confirming your rental. K5 does not charge merchants any setup fee, rental fee or deposit to host a station.

Businesses that host a K5 station ('K5 Powered Locations') agree to provide reasonable space and access for installation, restocking and maintenance, and to notify K5 promptly of any station malfunction, damage or relocation request. Station ownership, branding and equipment remain the property of K5 Power Network at all times.

When using our Services, you agree not to:

• Tamper with, damage, or attempt to disassemble any K5 station or power bank.
• Use the Services for any unlawful, fraudulent or abusive purpose.
• Interfere with the normal operation of any K5 station or the network.
• Resell or commercially exploit rented power banks without our written consent.

Our Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, K5 disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that a power bank or station will be available at all times or free from interruption.

To the fullest extent permitted by law, K5 shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services, including but not limited to loss of data or damage to your device, except where caused by our gross negligence or wilful misconduct.

You agree to indemnify and hold K5, its officers, employees and partners harmless from any claim, loss or damage arising from your breach of these Terms or misuse of the Services.

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, K5 Powered Locations, or K5 itself.

These Terms are governed by the laws of Malaysia, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date below. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
